Article 1 — Identification and scope
These Terms of Sale govern accommodation bookings made through the Eydenn platform, accessible at eydenn.com.
The platform is operated by EYDENN LTD, a company incorporated in England and Wales under number 15727880, whose registered office is at 61 Kensington Church Street, 1st Floor, London W8 4BA, England. Contact address: contact@eydenn.com.
Any booking implies unreserved acceptance of these terms, in the version in force on the booking date.
Article 2 — Definitions
- “Eydenn”: EYDENN LTD, operator of the platform.
- “Platform”: the eydenn.com website and any interface operated by Eydenn.
- “Traveller”: any person making a booking through the Platform.
- “Property”: the accommodation establishment listed on the Platform.
- “Accommodation price”: the total price set by the Property for the dates and services booked, excluding the booking and service fee.
- “Booking deposit”: the sum paid online by the Traveller, deducted from the accommodation price.
- “Balance”: the accommodation price less the deposit, paid directly to the Property.
- “Booking and service fee”: the fee charged by Eydenn to the Traveller for the booking service.
Article 3 — Eydenn's role
Eydenn acts exclusively as a booking intermediary. The accommodation contract is concluded directly between the Traveller and the Property. Eydenn is neither the accommodation provider, nor the organiser of the stay, and is not a party to the accommodation contract.
Eydenn provides the Traveller with a distinct service of booking, verification of listed properties, secure online payment, issuance of the booking voucher and assistance during the stay.
Eydenn selects the listed properties and verifies their existence and actual operation. This verification is neither a guarantee of the quality of the services provided, nor a substitute for the Property's liability.
Article 4 — Price and payment
4.1 Displayed price. The price displayed on the Platform, at every stage of the booking journey, is inclusive of all taxes and all mandatory fees. It comprises the accommodation price set by the Property for the selected dates and services, and the booking and service fee defined in article 4.2. No additional mandatory fee is added later. Optional services purchased on site, and local tourist taxes where the destination country's regulations require payment on site, remain payable by the Traveller and are flagged before booking.
4.2 Booking and service fee. The Eydenn booking and service fee amounts to 6% of the accommodation price. It pays for the service provided to the Traveller: verification of listed properties, secure payment, issuance of the booking voucher and local assistance during the stay. Its amount is disclosed to the Traveller in value, on a separate line of the order summary, before any payment, and on the payment receipt. This fee is already included in the displayed price referred to in article 4.1. It is not a supplement added during the booking journey.
4.3 Payment split. The stay is paid in two instalments: online at the time of booking — the booking deposit plus the booking and service fee; and at the Property during the stay — the balance, equal to the accommodation price less the deposit. The order summary, the confirmation and the booking voucher expressly state the amount paid online and the balance due at the Property. The Property contractually undertakes towards Eydenn to deduct the deposit from the total price and to charge the Traveller only the balance so defined; any difficulty must be reported to Eydenn without delay.
4.4 Currency. The Platform's reference currency is the US dollar (USD): rates are set, contractual amounts expressed and online payment collected in USD. For the Traveller's convenience, prices may be displayed in another currency (euro, pound sterling or dollar), selected automatically based on the Traveller's location or on an explicit choice. This display is an indicative conversion, at the prevailing rate, with no contractual value and not reproduced on the voucher. The amount actually charged is the one expressed in US dollars. Where the Traveller's payment method is denominated in another currency, the issuing bank may apply conversion fees that remain at the Traveller's expense.
4.5 Payment methods and security. Online payment is made by card via the payment provider Stripe, or via the mobile payment methods offered on the Platform. Eydenn stores no card data. The payment amount is determined exclusively by Eydenn's servers; any booking whose transmitted amount does not match the amount calculated by Eydenn is rejected.
4.6 Payment guarantee. At the time of booking, a payment guarantee may be required and passed to the Property. It allows the Property to apply its own cancellation terms to the balance, within the limits of those terms as disclosed to the Traveller before booking. Eydenn is neither guarantor, nor surety, nor payment intermediary in respect of the balance of the stay.
Article 5 — Booking and confirmation
The booking is firm upon actual collection of the online payment. The Traveller receives a booking confirmation and a voucher to present to the Property, stating the amount already paid, the balance payable on site and the free-cancellation deadline.
The Traveller is responsible for the accuracy of the information provided, in particular identity, stay dates and email address. Eydenn cannot be held liable for the consequences of incorrect information.
Eydenn reserves the right to refuse or cancel any booking in the event of suspected fraud, an invalid payment method or manifestly inaccurate information.
Article 6 — Cancellation, modification and refund
6.1 Cancellation by the Traveller. The Traveller may cancel free of charge and obtain a full refund of the booking deposit up to thirty (30) days before the arrival date. The Traveller also has, regardless of the arrival date, a period of twenty-four (24) hours from confirmation of the booking to cancel it and obtain a full refund of all sums paid, including the booking and service fee. This period may in no case extend beyond the scheduled arrival date and time. Beyond these periods, the booking deposit remains acquired by Eydenn. Where the booking is made less than thirty (30) days before the arrival date, the Traveller is informed explicitly before payment, the free-cancellation period then being limited to the twenty-four-hour period. The free-cancellation deadline is shown to the Traveller, as a date and time, in the order summary and on the booking confirmation.
6.2 Booking and service fee. The booking and service fee pays for a service fully performed upon confirmation of the booking. It is not refunded where the cancellation is made at the Traveller's initiative, except for a cancellation within the twenty-four-hour period provided in article 6.1 and the cases listed in article 6.4. The non-refundable nature of this fee is enforceable against the Traveller in that it was disclosed, in value and legibly, before payment.
6.3 Balance of the stay and no-show. As the balance is not collected by Eydenn, the Property's own cancellation terms apply to it. They are disclosed to the Traveller before the booking is confirmed and may give rise to a direct charge by the Property under the guarantee provided in article 4.6. Failure of the Traveller to arrive on the arrival date, without prior cancellation, entails forfeiture of the deposit as well as of the booking and service fee, without prejudice to the Property's own terms.
6.4 Cases of full refund. The deposit and the booking and service fee are fully refunded in the following cases: cancellation by the Property for any reason; inability of the Property to honour the booking (including overbooking, closure or unavailability of the booked accommodation); inability of Eydenn to offer replacement accommodation of equivalent category and location; substantial non-conformity of the accommodation with the published description, duly established; an error attributable to Eydenn in processing the booking or the amount collected; cancellation by Eydenn, including following delisting of the Property; unavoidable and extraordinary circumstances occurring at the destination and significantly affecting the stay, including natural disaster, epidemic, armed conflict or government travel restrictions. Where the Traveller accepts replacement accommodation offered by Eydenn, the deposit and the fee are recalculated on the price of the new accommodation; any difference in the Traveller's favour is returned.
6.5 Modification. Any modification request is subject to the Property's agreement and to availability. Where accepted, the deposit and the fee are recalculated on the new price. An accepted modification is not a cancellation and gives no right to a refund of the booking and service fee.
6.6 Refund arrangements. Any refund is made to the payment method used at booking, within a maximum of fourteen (14) days from recognition of the right to a refund. The cancellation email details the amount refunded, the amount retained and the applicable reason.
6.7 Right of withdrawal. In accordance with distance-selling regulations, the statutory fourteen-day right of withdrawal does not apply to accommodation services provided for a specific date or period. The terms of this article apply instead.
Article 7 — Rate consistency
Eydenn imposes no rate-parity clause on its partner Properties, which remain free to set their pricing policy across all their distribution channels. Each partner Property nevertheless undertakes, under its partnership agreement, not to publicly display, on its own booking website, a total price lower than the one offered on the Platform for identical dates, accommodation category and services. A Traveller who notices a discrepancy may report it to Eydenn, which checks with the Property and, where appropriate, adjusts the price or refunds the difference.
Article 8 — Traveller's obligations
- Provide accurate and complete information when booking.
- Pay the Property the balance of the stay as stated on the voucher.
- Comply with the Property's house rules and local regulations.
- Report to Eydenn, without delay, any difficulty encountered before or during the stay.
Article 9 — Liability
As Eydenn is not a party to the accommodation contract, it cannot be held liable for the performance of the stay, which is the sole responsibility of the Property.
Eydenn's liability is limited to breaches of its own obligations as defined in article 3, and may not exceed the total sums it has collected for the booking concerned.
Eydenn cannot be held liable for a breach resulting from unavoidable and extraordinary circumstances beyond its reasonable control.
Article 10 — Personal data
Eydenn processes the Traveller's personal data for the purposes of managing the booking, payment, assistance and compliance with its legal obligations, in accordance with its privacy policy.
The data necessary to perform the stay is passed to the Property, which refrains from any reuse for marketing purposes without the Traveller's separate consent.
The Traveller has the rights of access, rectification, erasure, objection and portability, exercisable at contact@eydenn.com.
Article 11 — Intellectual property
All elements making up the Platform are protected by intellectual property law. Any reproduction, extraction or reuse, in whole or in part, without Eydenn's prior written authorisation is prohibited.
Article 12 — Claims and disputes
Any claim relating to the stay must be sent to Eydenn at contact@eydenn.com within thirty (30) days of the end of the stay. Eydenn acknowledges receipt within five (5) working days and provides a reasoned reply within thirty (30) days.
These terms are governed by English law. Failing an amicable resolution, any dispute falls under the courts of England and Wales, without prejudice to the mandatory consumer-protection provisions applicable in the Traveller's country of residence.
Article 13 — Amendment
Eydenn may amend these terms at any time. The terms applicable to a booking are those in force on the booking date. The possible invalidity of any provision does not affect the validity of the others.
